These terms and conditions (“Terms“) apply to all purchases made on the Vinyl Deli website (“Site“) by any customer (“You/Your“) from Vinyl Deli (“We/Us/Our”), based in the United Kingdom. Acceptance of Orders
All orders placed through Our Site are subject to Our acceptance. We reserve the right to refuse or cancel any order, whether confirmed or not, for any reason and without liability to You. If a charge has been made and the order is cancelled, a refund will be issued.
When We Accept Orders
We only accept orders when We have checked them. Once an order is received, We will email You to confirm that We’ve received Your order, and once the order is accepted, We will confirm the dispatch details.
Order Rejections
Sometimes We may reject orders, such as when the goods are unexpectedly out of stock, when You are located outside Our delivery areas, or if a product was mispriced. In these cases, We will inform You as soon as possible and refund any sums You have paid.
Age Requirements
By placing an order, You confirm that You are over 18 years of age if the goods in question carry age restrictions.
Prices and Charges
All prices and charges, including delivery fees, are displayed on Our Site and may change without notice. The applicable price is the one shown on Our Site at the time of order, subject to correction of any errors. If We identify a pricing error in Your order, We will inform You as soon as possible, at which point You may reconfirm or cancel Your order. Taxes, including VAT, may be added as required by UK law. We may adjust the price for any changes in VAT or other sales tax rates, and these will apply to Your order if the rate changes between Your order date and the dispatch date.
Product Availability
All items are subject to availability. We strive to ensure that product descriptions and availability information are accurate, but availability may change without notice. The product You order may differ slightly from its image on Our Site due to differences in screen displays or packaging updates.
Delivery
Delivery will be arranged as soon as possible following order acceptance, with an expected timeframe of no less than 30 days from order processing. If We are unable to meet this timeframe, You will be notified promptly and have the option to cancel the order. Delivery fees are applied at checkout based on location and delivery method.
Risk of loss transfers to You upon delivery to the carrier. You are responsible for any claims related to lost or damaged items in transit. Ownership transfers to You once full payment has been received and the order has been delivered.
- Failed Deliveries:
If delivery is attempted and You are unavailable to receive the goods, or if You provide an incorrect address, You will be responsible for the cost of any re-delivery. - We may require additional shipping fees for re-delivery or for goods returned to Us due to non-collection.
- Delivery Delays:
While We strive to deliver within the stated timeframe, any dates provided are estimates. We cannot guarantee specific delivery dates and are not liable for delays outside of Our control. However, if delivery is delayed by more than 30 days, You may cancel the order and receive a full refund.
Returns, Refunds, and Administrative Fees
- Return Process:
To process a return or cancellation, You must provide Us with the order number, proof of purchase, and the reason for the return within the applicable return period. Returns should be sent to the address provided by Us in the return instructions. - If You receive a faulty or damaged product, please notify Us within 7 days of receipt, providing photographs of the damage or fault to speed up the process.
- Faulty or Incorrect Items:
If You receive a faulty, defective, or incorrect item, We will offer a replacement, a repair, or a full refund, depending on the situation. We will cover the cost of return shipping in these cases. - Exclusions:
The following items are excluded from the right to cancel or return: - Sealed audio/video recordings (e.g. vinyl records) once opened.
- Digital goods, such as downloadable music files, unless they are faulty.
- Items marked as non-returnable or made to order.
- Administrative Fees:
We reserve the right to charge a small administrative fee for processing returns and cancellations. The fee will be deducted from Your refund amount and will be made clear before the return is processed. In cases where We are at fault (e.g., damaged or incorrect items), no administrative fee will be charged. - Refunds:
Refunds will be processed within 30 days, minus initial delivery and administrative fees. - Right to Change Your Mind:
If You bought goods online, You may have the legal right to change Your mind and receive a refund within 14 days of receiving the goods (or the last item in a multi-item order). Return postage is Your responsibility unless otherwise stated. Goods must be returned in their original, unopened condition.
Subscription Plans
Our subscription products, Renaissance, Quite Delicious, and Oakley (collectively referred to as “Subscription”), are unique services that follow their own specific delivery schedules, payment terms, and return policies. By subscribing, You agree to the following terms:
- Delivery Schedule:
Subscription deliveries are processed on a monthly basis. Payments are taken between the 20th and 19th of each month, and Your order will be dispatched once Your payment is processed and in accordance with Our monthly schedule. All delivery dates are approximate and may vary slightly due to stock availability or delivery issues. We will notify You of any major delays. - Payments:
By subscribing to a Subscription plan, You agree to be charged according to the billing cycle of Your selected plan. Payments will be processed within the subscription window (20th to 19th of each month) for monthly plans, and on the renewal date for bi-annual or annual plans. If You cancel Your Subscription, You may be eligible for a refund for any unused portion of Your Subscription, less any applicable administrative fees. Refunds will not be issued for the current billing period. The refund amount will be calculated based on the time remaining on Your subscription, and administrative fees may be deducted. - Exchanges for Duplicate Records:
If You receive a vinyl record in a Subscription selection that You already own, We will gladly accept exchanges for an alternative vinyl record, provided the returned item is in the same condition it was sent to You in. Duplicate records are non-refundable and We only accept exchanges. Duplicate records are non-returnable if You receive a record You already own and Your Subscription stands inactive. Exchanges are subject to availability of alternate vinyl records. - Damaged or Defective Records:
If You receive a vinyl record that is damaged or defective, please email Us within 7 days of receipt with a photo or video of the damage. We reserve the right to determine if a replacement will be issued based on the severity of the damage. Minor issues such as cosmetic creases or scuffs may not qualify for a replacement, but We will offer an alternative vinyl record, a refund, or a store credit in these cases. Please be aware that if the vinyl is a second-hand or limited edition item, a replacement may not be available. - Non-Returnable Items:
Due to the nature of Subscription plans, We cannot accept returns for any vinyl records once opened, unless they are faulty or damaged as described above. - Communication and Response Time:
We will always endeavour to respond to Your Subscription queries or issues within 48 hours. If a replacement, refund, or exchange is necessary, We will process it as quickly as possible.
Goods Can Vary Slightly
The packaging and description of Your goods may be slightly different from that shown on Our website or in Our marketing. We are not liable for any minor variations.
Failure to Collect Goods
If You book event tickets which include goods for collection, You will forfeit the goods if not collected within six months of the event. We may, at Our discretion, resupply any uncollected goods.
Force Majeure
We are not responsible for delays outside Our control, such as acts of nature or transportation delays.
Your Personal Data
We will use Your personal data in accordance with Our Privacy Policy.
Suspension or Withdrawal of Supply
We reserve the right to suspend or withdraw goods from sale without notice. In such cases, We will notify You promptly, and You may be entitled to a refund for any prepaid goods not yet delivered.
Limitation of Liability
We do not compensate You for all losses caused by Us. Our liability is limited to the amount You have paid for the goods or services in question.
Termination of Contract
We reserve the right to end Our contract with You at any time.
Severability
If any provision of these Terms is found to be unenforceable, the rest of the Terms will remain valid.
Governing Law
These Terms are governed by the laws of England and Wales. By using Our Site and purchasing from Us, You consent to the jurisdiction of the courts of England and Wales.
